After a US federal appeals court determined that President Donald Trump’s “reciprocal” tariffs were illegal, the US’s trading partners are now facing a new period of uncertainty.
The judges, in a 7-4 vote, said that Trump had gone too far by using emergency powers to put tariffs of “unlimited duration on nearly all goods from nearly every country in the world.” This verdict upheld an earlier court ruling.
The decision will mess up the plans of trading partners who are still talking to the US, and they may decide to wait and see what happens in the court case.
There are other ways to fight the ruling, but Trump has made it plain that the next stop will be the Supreme Court.
The US Court of Appeals for the Federal Circuit decided that the tariffs will stay in effect until October 14 so that more appeals could be made.
Two important things came out of this new decision.
First, the “liberation day” taxes are against the law right now. Second, these “illegal” tariffs will stay in place for now so that the different ways to protest can be looked into.
Under the executive orders in question, money will still be gathered. If the appeals court rules that the tariffs are illegal, that money might have to be refunded.
This decision does not cover all tariffs. It doesn’t cover taxes on certain industries, like those on steel and aluminum. But other tariffs that Trump put in place during his first term have already been found to be illegal by the World Trade Organization. They are now being appealed through the international dispute settlement system.
The most recent decision did not overturn the decision to end the de minimis exception, which caused postal chaos around the world. If the decision is confirmed, however, the tariff rates on low-value goods will go back to the percentages they were before “liberation day.” Most of the time, this would mean “back to zero.”
“ALL TARIFFS ARE STILL IN EFFECT!” Trump wrote on Truth Social in a lengthy post following the ruling.
“Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end. If these Tariffs ever went away, it would be a total disaster for the Country. It would make us financially weak, and we have to be strong.”
“The U.S.A. will no longer tolerate enormous Trade Deficits and unfair Tariffs and Non Tariff Trade Barriers imposed by other Countries, friend or foe, that undermine our Manufacturers, Farmers, and everyone else. If allowed to stand, this Decision would literally destroy the United States of America.”
“At the start of this Labor Day weekend, we should all remember that TARIFFS are the best tool to help our Workers, and support Companies that produce great MADE IN AMERICA products. For many years, Tariffs were allowed to be used against us by our uncaring and unwise Politicians. Now, with the help of the United States Supreme Court, we will use them to the benefit of our Nation, and Make America Rich, Strong, and Powerful.”
The Constitution gives Congress the power to impose tariffs, but over the decades, lawmakers ceded authority to the president.
Trump argued his authority mirrored that of Richard Nixon, who used emergency powers in 1971 to impose tariffs after ending the dollar’s link to gold.
The trade court rejected the argument in May, combining challenges from five businesses and 12 states.
The appeals court upheld that ruling but left the tariffs in place while Trump appeals to the Supreme Court.
